Influencer program
FijiCareers.com Influencer Program Agreement
What you earn from your link, how paid promotion works separately, what you may and may not post, and how either of us can end it.
1. Who this agreement is between
This agreement is between you and HiveRef Pty Ltd (ACN 697 040 136) trading as FijiCareers.com. FijiCareers.com is the trading name you know us by, and HiveRef Pty Ltd is the company behind it: the party to this agreement and the company that pays your commission. In this document "we", "us" and "our" mean that company, and "you" means the person or business accepting this agreement.
It covers the FijiCareers.com Influencer Program. It starts the moment you accept it at sign-up and continues until you or we end it under section 11.
You can be anywhere in the world. This programme is not limited to Fiji. A Fijian living overseas may know exactly the Business we want to reach, and that introduction is worth the same as one made in Suva. What changes with your location is the law you have to follow when you promote us, how we can pay you, and who taxes what you earn. Sections 8, 5 and 15 deal with each of those.
You are not our employee, agent or representative. You are independent. You choose whether to promote us at all, and how much time to give it. Nothing here makes you our employee, our agent, our joint venturer or our legal partner, and you must not tell anyone otherwise or sign anything on our behalf.
Two words have a set meaning in this agreement, and carry a capital letter wherever they carry that meaning. They decide whose buying you earn from, so they are settled here rather than left to the sections that rely on them:
- Business: any organisation that advertises jobs with us, including a company, a sole trader, a partnership, a government body, a statutory authority, a school or a not-for-profit.
- Employee: one individual person with their own login to a Business, including an owner or a director. A Business may have more than one Employee, each with their own login, and each of them is counted separately under this agreement.
You need to be neither one of them. A partner needs to be neither a Business nor an Employee, and most partners are neither. An accountant who introduces her clients has no login to any Business, does not need one, and is paid exactly as any other partner is. Employee says what somebody is to a Business and never what they are to us: the clause above says what you are to us, and nothing in this agreement makes you our employee.
2. Who can join
You must be 18 or over and legally able to enter a contract where you live.
You must give us accurate details, and keep them accurate. Your name, your email, and the account we pay into. We type your payment details into a transfer by hand, so a number that has changed is a payment that fails rather than one that retries. You add your payment details yourself on your partner dashboard after you sign up, and you can update them there at any time.
One partner record per person. You are issued one referral code, and it is the same code whichever programme you joined through. If you apply again with the same email, through either form, we will show you the code you already hold rather than issue a second one. Creating extra records to collect commission more than once is a breach of section 9.
The person holding that record is one individual, not a business. You do not have to be a Business or an Employee to hold one, and most partners are neither. Where several Employees of the same Business each have their own login, each of them is a separate individual here, each may hold their own partner record, and section 4 counts each of them separately.
We can decline anyone, and we do not have to say why. Accepting this agreement does not oblige us to issue you a code or to keep one active.
3. Your link and your code
When you join we give you a referral code and a link that carries it. The link is yours, it works straight away, and it is the only way we can see that an Employee came from you.
The code is yours to share, not to sell. Share it as widely as sections 8 and 9 allow. Do not sell it, rent it, auction it, or pass it to someone else to use as their own.
We may change or reissue a code if it is being misused, if it clashes with another, or if we have to change how links work. We will tell you before we do, unless the misuse is serious enough that waiting would make it worse. Commission you have already earned is not affected.
4. How you earn
A referral counts when someone clicks your link and then buys. Not when you tell them about us, not when you send them the link, not when they mention your name. The click is what we can see, and it is the only thing we can prove.
You have 90 days. From the moment an Employee clicks your link, you have 90 days for them to make a purchase. If they buy in that time, that Employee is yours.
Then they are yours for life. Once an Employee has made their first purchase through your link, you earn 20% of everything they ever buy from us. Not for a year. For as long as they keep buying.
Every click restarts the clock. If 90 days pass with no purchase, you have not lost them permanently. Get them to click your link again and a fresh 90 days begins.
One partner per Employee, ever. An Employee can only ever have one referring partner. Once they have bought through your link, nobody else can claim them, and we will never move them to someone else. That rule protects you as often as it costs you.
Commission follows the Employee who made the purchase, normally whoever holds the Business's card. Each Employee of a Business is counted separately, so two Employees at one Business who came through two different partners each earn for their own partner, and neither partner can take the other's. The same rule cuts the other way: introducing one Employee does not give you the purchases another Employee of that Business later makes through their own login.
What this means you will not be paid for through your link. Everything in this section is about your referral link, which is the Referral Program side of this agreement and which every influencer also has. It does not concern paid promotion, which is what the Influencer Program is for and which is paid only under its own written brief, as section 16 explains. The fee for a paid post is set by its brief, and nothing below adds to it or takes from it. On the link side, these follow from the rules above and we would rather you read them now than discover them later:
- You told an Employee about us and they signed up directly, without ever clicking your link.
- They clicked 100 days ago, never clicked again, and bought today.
- Another partner's click was the live one at the moment they bought.
- The Employee was already bound to another partner before you reached them.
If the tracking missed a referral you genuinely made, tell us. A new Employee is asked how they heard about us when they register, and can name your code there. That creates a claim that a person reviews. A code typed in that box never pays commission on its own, and we decide each claim on the evidence. Section 7 explains what happens if you disagree with the outcome.
You may refer your own business. If you are an Employee of a Business, including its owner, you may use your own link for your own purchases. We allow this deliberately.
5. What we pay you, and when
20% of what the Employee actually pays us. Calculated on the amount we receive, in the currency we charge, before any of our own costs. Where an Employee buys post credits, you earn 20% of the money paid at the time it is paid, however many of those credits they later use.
There is no minimum and no threshold. An $18 commission is paid as $18. We do not hold your money until it reaches a round number, and there is no sign-up bonus or first-sale bonus for anyone, so nobody is earning one you are not.
You earn it the moment the Employee's payment reaches us. Not when they place the order, and not after a holding period. There is no clearing window.
We pay it within 30 days of receiving that payment. The 30 days is how long it takes us to make the transfer by hand. It is not a wait before you have earned the money. Your dashboard shows what is owed to you today.
We pay by the method you choose on your partner dashboard. Inside Fiji: bank transfer, M-PAiSA or MyCash. Outside Fiji: PayPal or Wise. M-PAiSA and MyCash work inside Fiji only, and we do not send bank transfers to banks outside Fiji. We cannot send you a payment until you have added your payment details there. Commission you earn before then is still recorded and still owed to you. You can change your details yourself at any time.
Inside Fiji we pay the cost of sending. Outside Fiji you pay it. If we pay you by bank transfer in Fiji, M-PAiSA or MyCash, we pay the fee for sending, and you receive the full commission. If we pay you by PayPal or Wise, you pay the fee for sending: we take the fee PayPal or Wise charges us for that payment out of your commission, and send you the rest. The statement for each commission shows the commission, the fee and the amount we sent. Any fee charged on your side is also yours, wherever you are: your own bank's charges, an intermediary bank, or what PayPal or Wise charge you to receive or convert the money. We cannot control or predict those. On small commissions the fees can be a large share of the amount, which is worth knowing before you count on a payment from overseas.
Tax is yours to handle. We do not withhold tax, and what you owe depends on where you live rather than where we are. You are responsible for declaring what you earn and paying whatever your own country asks for. If you sign up as a business, we pay the business and the transfer is made out to the business name you gave us.
If we owe you nothing, nothing is paid. Commission is only ever earned on a purchase that the rules in section 4 award to you.
6. When commission is taken back
Commission follows money that stays with us. If the Employee's payment is reversed, the commission on it is reversed too. This happens when:
- we refund the Employee, in full or in part,
- the Employee's bank or card issuer charges the payment back, or
- the payment turns out to be fraudulent.
A partial refund reverses the same share of the commission, and no more. Refund a quarter of what an Employee paid and a quarter of your commission on it goes back, while you keep the rest. Refund all of it and the whole commission goes. We work each one out from the original purchase price, so several partial refunds on the same purchase can never take back more between them than was actually returned to the Employee.
A disputed payment is reversed the moment the dispute opens, because that is when the money leaves our account. If we later win the dispute, the commission goes back to where it was: still owed if we had not paid it yet, and left alone if we already had.
If we have already paid you commission that is later reversed, we will take it off your next payment. If there is no next payment within a reasonable time, we may ask you to repay it, and you agree to do so. We will always show you which purchase it relates to.
We may withhold payment while we investigate a purchase or a pattern of clicks we have genuine reason to think is fraudulent, and for no longer than that investigation takes. If we find nothing wrong, we pay you in full.
7. If you disagree with us about a referral
Our records are the evidence we go on. We log every click on a partner link: the time, the code, and enough technical detail to tell one visit from another. Where there is a question about who introduced an Employee, that log is what answers it.
A person looks at it, not only the software. If you think we have it wrong, write to theteam@fijicareers.com with the detail. We will check the record and explain what it shows, and where a referral is genuinely in question one of our team decides it and tells you why. Most questions end before that, because the log usually answers them plainly.
Nothing here takes away rights you have under your own country's law. If the law where you live gives you a right that this section appears to remove, that law wins and this section is read as not applying to it.
8. How you may promote us
Tell the truth about us. Describe FijiCareers.com as it actually is: a place to find jobs in Fiji, and a place for a Business to advertise them. Everything you say about us has to be something we could stand behind.
Say that you earn from it. Whenever you post, message or publish anything promoting us, make it obvious that you have a commercial relationship with us and stand to earn from it. Put the disclosure where someone sees it before they click, not at the end of a caption or behind a More link. Plain words work best: "I earn a commission if you sign up through my link", or a clear #ad. This is not only our rule. Advertising regulators in Australia, the United States, the United Kingdom and elsewhere treat an undisclosed paid endorsement as misleading conduct, and it is you who is exposed if a regulator where you live takes an interest.
Follow the law where you are, and where your audience is. Disclosure, advertising, spam and privacy rules differ by country and we cannot advise you on yours. You are responsible for meeting the ones that apply to you.
Use the materials we give you. There is a toolkit of artwork and logos at fijicareers.com/partners/toolkit, sized for each platform and free to download whenever you need it. Using it is the easiest way to stay inside section 10.
Keep it your own voice. We are not asking you to read a script. Your audience trusts you because you sound like yourself, and a post that reads as ours rather than yours works for neither of us.
9. What you must not do
Do not put us in the same content as a competing platform. This is the rule most likely to catch you out, so it is stated first and stated precisely. In any post, video, story, reel, email, article or page that promotes us, you must not also promote, link to, or recommend another job board, recruitment platform or classifieds site. Specifically, you must not:
- list us as one option among several platforms, including in a "best job sites" post, a roundup, a comparison or a ranking,
- place our name, logo or artwork in content that also carries a competitor's,
- use our materials, our logo or our link in anything that promotes a competitor, or
- run our link and a competitor's link in the same post, the same story sequence, the same email or the same link-in-bio section.
You are still free to work with competitors, separately. We are not asking you to promote nobody else. Post about another platform on another day, in its own content, without our name or artwork in it, and you are within this agreement. What we are buying with the 20% is that when you are recommending us, you are recommending us, rather than handing your audience a menu.
Do not attach us to content we would not want to be attached to. Do not promote us in or alongside content that is unlawful, sexually explicit, violent, hateful, discriminatory, harassing, defamatory, or that attacks a person or a group. Do not use us in party political campaigning. Fiji is a small market and a partner's audience remembers who was standing next to whom.
Do not mislead anyone about what we do. In particular, never promise or imply any of the following, because none of them are things we do:
- that we can get someone a job, guarantee an interview, or influence a Business's hiring decision,
- that a job seeker must pay us, or pay you, for anything. Job seekers use FijiCareers.com free,
- that we offer visas, migration help, work permits or overseas placement,
- that you work for us, speak for us, or that we have endorsed or verified you, or
- that a job exists when it does not, including inventing a listing, a salary or a Business to attract clicks.
Do not spam. No bulk email to addresses that did not ask to hear from you, no bought or scraped contact lists, no mass unsolicited SMS or WhatsApp, no repeated posting into groups or comment sections where it is not wanted, and nothing that breaks the messaging rules of the platform you are on.
Do not bid on our name in paid search. You must not buy search advertising on "FijiCareers", "Fiji Careers", our domain, or close misspellings of them, and you must not use those terms in the display URL of any ad. Someone searching for us by name has already found us, and paying for that click twice helps nobody.
Do not fake clicks or traffic. No bots, no automated clicking, no click farms, no dropping our tracking onto people who never chose to visit us, no hidden frames or redirects, and no putting your code on someone's device without them clicking your link. Commission earned this way will be reversed and the account closed.
Do not impersonate us. Do not register domains, social accounts, pages or app listings using our name or anything close enough to be mistaken for it. Do not copy our website, run anything that looks like an official FijiCareers page, or answer messages as though you were us.
Do not collect job seekers' personal information in our name. Do not ask people to send you their CV, their ID, their bank details or their contact details on our behalf, and do not run an application process of your own that borrows our name. Send people to the site and let them apply there.
Do not charge anybody for access to us. Your link is free to use. You must not sell it, put it behind a paywall, or charge a job seeker, a Business or an Employee a fee to be referred.
Do not present yourself as an official ambassador or spokesperson unless we have agreed that in writing for a specific piece of paid work. Being a partner means you earn commission from us. It does not mean you represent us.
If you are not sure whether something is allowed, ask first. Write to theteam@fijicareers.com. We would far rather answer a question than reverse a commission.
10. Using our name, logo and artwork
We give you permission to use our brand, on these terms. While this agreement is running you may use the FijiCareers.com name, logo and the artwork in the partner toolkit, for the sole purpose of promoting us under this agreement. The permission is personal to you, non-exclusive, and we can withdraw it.
Use the artwork as supplied. Do not stretch it, recolour it, crop the logo, add your own wording inside it, or combine it with another brand's marks. Every size in the toolkit exists so that you never have to resize one yourself.
The brand stays ours. Nothing here gives you ownership of our name, logo or artwork, and any goodwill your promotion builds in them belongs to us. You must not register or try to register anything confusingly similar to them anywhere in the world.
Stop using it when this agreement ends. Within 14 days of the agreement ending, take our logo and artwork down from anything you control: your profiles, your link-in-bio, your website, your pinned posts. You do not have to delete old posts from your feed history, but you must not keep presenting yourself as a current partner.
What you post stays yours. You keep ownership of content you create. You give us permission to reshare or quote content you have published about us, on our own channels, with credit to you. If you would rather we did not reshare a particular post, tell us and we will not.
11. Suspending or ending this agreement
You can leave at any time, by telling us at legal@fijicareers.com. Stop using the link and the artwork when you do.
We can end it at any time, with 14 days' notice by email. We do not have to give a reason.
We can suspend or end it immediately if we have genuine reason to believe you have breached section 9, faked traffic, or done something that puts us at legal or reputational risk. Where it is sensible to, we will tell you what the problem is and give you a chance to fix it.
Commission you have properly earned survives the ending. If this agreement ends and money is owed to you on purchases already made, we pay it on the normal timetable. The one exception is where we end the agreement because of fraud or faked traffic, in which case we may withhold commission connected to it.
What does not survive is future earning. Once the agreement has ended, Employees bound to you stop generating new commission from their later purchases. Lifetime means the life of the arrangement, not beyond it.
These sections keep working after it ends: 6 (clawback), 7 (disputes), 10 (brand, including the 14 days to take it down), 12 (liability), 13 (indemnity) and 15 (law).
12. What we are and are not responsible for
We do not promise you will earn anything. Nothing in this agreement is a forecast, a target or a guarantee of income. What you earn depends on whether the Employees you introduce choose to buy from us, which is not something either of us controls.
We do not promise the site or the tracking will never fail. We will take reasonable care with both. We cannot guarantee that the site is always available, that every click is recorded, or that a link works on every device and in every app. Where a technical failure of ours has clearly cost you a referral, tell us and we will look at it on its merits.
We may change the programme. We may change our prices, our products, our commission rate or these terms. We will give you at least 30 days' notice by email before a change that reduces what you earn, and it will not apply to commission already earned. If you do not accept a change, you may end this agreement under section 11.
Our liability is limited. If we are liable to you for something connected to this agreement, our total liability is capped at the commission we paid you in the 12 months before the problem arose, or FJD $500 if that is greater. We are not liable for lost profit, lost opportunity or indirect loss.
Some liability cannot be limited, and we do not try to. Nothing in this agreement excludes liability for fraud, for death or personal injury caused by our negligence, or for anything that the law where you live does not permit us to exclude. Where a consumer guarantee applies to you under your own country's law, it applies despite this section.
13. If your promotion causes us a problem
If someone brings a claim against us because of something you published, said or did while promoting us, and it breached this agreement or the law, you agree to cover the reasonable cost of dealing with it. We will tell you promptly if that happens, let you have a say in how it is handled, and not settle it without asking you first.
This is about your conduct, not ours. It does not apply to a claim that arises from our own content, our own site, or anything you did by following written instructions from us.
There is a limit on what this can cost you. The most you can be asked to cover under this section is the greater of FJD 1,000 or the commission we paid you in the twelve months before the claim. This programme pays small amounts to individuals, and an open promise to cover our legal costs would be out of all proportion to what you earn from it. The limit does not apply if you acted fraudulently.
14. Data and privacy
What we hold about you. Your name and contact details, your payment details, the town you gave us, the links you told us about, and the record of clicks, referrals and payments on your account. We hold it to run the programme and to pay you, and we keep the click log for as long as a commission question could still be raised about it.
Your partner record is not public. We do not publish a list of partners, and we do not tell a Business or an Employee who referred them.
What we hold about the people who click. Your dashboard shows counts, not people. You never receive the name, email or contact details of anybody who clicks your link or of any Employee bound to you, even though you earn from them.
If you collect anything yourself, it is yours to look after. If you run your own list, form or group as part of promoting us, you are responsible for it under the privacy law that applies to you. You are not collecting it on our behalf and you must not say that you are.
15. Law, and the rest
This agreement is governed by the law of New South Wales, Australia. HiveRef Pty Ltd is an Australian company, and the programme is run, recorded and paid from there. One law reads this agreement for every partner, so the same words mean the same thing whether you are in Suva, Sydney or Auckland.
The courts of New South Wales have non-exclusive jurisdiction. Non-exclusive is the important word. It means we may bring a claim there, and it does not stop you bringing a claim where you live if the law there allows it. Nothing in this agreement asks you to travel to another country to be heard over a commission.
Nothing here removes a protection you cannot give up. Most partners are outside Australia, so this needs saying plainly. Where the law where you live gives you a right this agreement appears to take away, that law wins and this agreement gives way to it. Choosing Australian law does not displace consumer or other mandatory protections you have at home.
You follow the law that applies where you operate. That is a separate promise from the one above, and it runs the other way. Whose law reads this agreement does not change which rules you must obey where you work: advertising and disclosure, messaging and spam, privacy, and tax. We cannot tell you what those are in your country and we do not try to. Section 8 covers how you may promote us, section 5 covers tax on what you earn, and section 14 covers data.
This is the whole agreement between us about the programme, together with the attribution summary shown at sign-up. If any part of it turns out to be unenforceable, the rest still stands.
You cannot transfer this agreement to someone else without our written agreement. We may transfer it if our business is sold, and we will tell you if that happens.
If we do not enforce something straight away, that does not mean we have given up the right to enforce it later.
Notices go by email. Ours to the address on your partner record, yours to legal@fijicareers.com. Keep your email address current, because that is where a notice about a change to what you earn will arrive.
16. Paid promotion is a separate arrangement
This agreement covers your link, not paid posts. Two different things can earn you money from us, and they work differently:
- Your referral link. Live the moment you join, open to everyone, pays 20% when an Employee you introduced buys something. That is this agreement.
- Paid promotion. A fee we agree with you for content you make and post. Decided case by case, agreed in writing each time, and not covered by this agreement.
Joining does not entitle you to paid work. We review content applications one at a time and we may say no. Rates depend on your reach and how often you post, so we do not publish them.
Being declined for paid work changes nothing about your link. You remain a partner in good standing, your code keeps working, and you keep earning 20% on every Employee you introduce. We will never suspend a partner as a way of saying no to a content pitch.
Each paid piece gets its own written brief, covering what you will post, where, when, the fee, and how long it stays up. If anything in that brief conflicts with this agreement, the brief wins for that piece of work only.
Paid content must be disclosed as paid, in the way the platform provides for it and in the words your own regulator expects. Section 8 applies to paid content with more force, not less.
